Section 1: Definitions
For the purposes of this handbook only, the following definitions shall apply:
- Appointment Status shall refer to the form of appointment held by an individual management employee and may result in differences in rights or obligations relating to the employment relationship. There are five primary types of appointment status:
- Annual appointment shall mean the form of appointment provided for employees who are in probationary status and may be either full-time or part-time.
- Continuous appointment shall mean the form of appointment provided for employees who have completed their probationary period and have been approved for appointment by the Board of Directors.
- Special appointment shall mean the form of appointment provided for employees whose positions are funded by sources other than the College General Fund. Special appointments may be either “special annual” or “special continuous” and may be either full-time or part-time.
- Temporary appointment shall mean the form of appointment provided for employees who fill general fund positions for a defined period of time. Such appointments are typically for an extended period and must exceed 1040 work hours. Temporary appointments may also be made for periods of a full academic year or longer. Individuals hired for less than 1040 hours are considered casual employees
- Interim appointment as used in this handbook shall mean an individual employed as a short term replacement for an individual on vacation, an approved leave of absence or sabbatical or the period necessary for a recruitment and selection process to fill a vacant position.
- Board shall mean the Board of Directors of Portland Community College District as the elected representative of the citizens of the Portland Community College District.
- Casual Employee shall mean any person employed in a job approved for less than 1040 hours in a fiscal year. Casual employees do not receive benefits and are not covered by the provisions of this handbook.
- Confidential Employee is a term derived from the Oregon Public Employees’ Collective Bargaining Act and by statutory definition, means any employee of the College who assists and acts in a confidential capacity to a person who formulates, determines and effectuates management policies in the area of collective bargaining ORS 243.650(6).
- Day shall mean a day which falls on Monday through Friday and excludes holidays and other days when the College is closed, unless the term “calendar days” is used. When the term calendar days is used it means Monday through Sunday.
- Employee shall mean any Management or Confidential person employed in an approved part-time or full-time job unless differentiation is specified.
- Executive Officer refers to the President of the College, the Campus Presidents, the Vice-President of Administrative Services and/or the District Vice-President either as a group or individually as appropriate to the context of the provision of this handbook in which the term appears.
- Exempt refers to employees excluded from the Federal Fair Labor Standards Act overtime laws.
- Full-Time Employee shall mean any person employed in a job budgeted for 2080 hours (1.0 FTE) per fiscal year receiving full benefits.
- Funds The College budgets in accordance with the Oregon Local Budget law and the budget consists of multiple Funds.
- General Fund is that portion of the total budget of the College based on revenues derived from tuition and fees from credit classes, state support and property tax income. The General Fund is often referred to as the operating fund of the College in which the majority of the instructional programs reside.
- Auxiliary Enterprise Funds are other funds are established for specialized purposes and are based on other forms of revenue; auxiliary funds are the ancillary services of the College, such as parking and transportation, food services, bookstores and print services.
- Grant “4” Funds are the budgets for specialized service programs with revenue sources dependent on external grants or contracts (positions within these funds are often referred to as “soft-money” positions). Due to the temporary or renewal cycle nature of some funding sources, the employment relationship of individuals employed in these fund areas may vary from those of General Fund employees.
- “1900 Funds” are programs that, under the College budget policy, operate on a self-supporting basis.
- Other Non-General Funds are for specialized programs such as the Risk Management Fund and Capital Projects Fund.
- Management When used in the context of collective bargaining authority, “management” refers to the Board or to the person(s) to whom the Board has delegated its authority. In all other context within this handbook, “management” refers to employees of the College who are not executive officers but whose job duties include the exercise of management authority. This term may apply either to a group or to an individual as appropriate to the context of the provision of this handbook in which the term appears.
- Non-Exempt refers to employees covered by the Federal Fair Labor Standards Act overtime laws.
- Part-Time Employee shall mean any person employed in a job budgeted for at least 1040 hours (.5 FTE) but less than 2080 hours per fiscal year. Individuals employed in part-time jobs covered by this handbook are eligible for benefits on a pro-rated FTE basis. An employee assigned to more than one job (excluding casual employment) will receive full benefits if the jobs total 2080 hours; otherwise benefits will be pro-rated.
- President shall mean the District President of Portland Community College.
